1. Purpose and scope

This copyright page describes the intellectual property rights in iCasting's platform, the rights in user content and the procedure for reporting a possible infringement.

This page supplements the Terms of Use, the Terms of Delivery, the Disclaimer and the Privacy Policy and Cookie Policy.

2. Rights of iCasting

All intellectual property rights in the name iCasting, the logo, trade names, design, format, structure, texts, images, videos, audio, software, source code, database, search engine, matching technology and other content of iCasting belong to IQ-Concepts B.V. or its licensors.

These rights include, among others, copyrights, database rights, trademark rights, trade name rights, design rights, know-how and other intellectual property rights. This list is not exhaustive.

The user is granted only a limited, personal, non-exclusive and non-transferable right to use the platform and the content available on it for the purpose for which iCasting makes it available.

Without iCasting's prior written permission, it is not permitted to:

• copy, download, reproduce or duplicate content or parts of the platform;
• edit, translate, modify or create derivative works;
• distribute, publish, forward or make available to third parties;
• commercially exploit or include in another database;
• read out automatically, scrape or systematically collect;
• use for training, testing or developing a model, algorithm or automated service;
• use in a way that may cause confusion about the origin or endorsement by iCasting.

These restrictions do not apply to the extent that a statutory exception, such as a quotation right, exhaustion rule or other mandatory limitation, permits such use.

3. Rights in user content

The user retains the intellectual property rights in texts, photos, videos, audio, logos, profile information, casting calls and other content that they post on or via the platform, unless otherwise agreed in writing or insofar as rights belong to a third party.

By posting user content, the user grants iCasting a non-exclusive, worldwide, royalty-free licence for the duration of the use of the services and thereafter only for as long as reasonably necessary for backups, recovery, disputes, security or a legal obligation, to:

• receive, host, store and technically process the content;
• display it on profiles, in search results, matching results and casting calls;
• distribute it among users insofar as this is necessary for talent matching and communications;
• technically adapt it, for example by changing format, resolution or cropping;
• secure, moderate, back up and recover it;
• use it for offering, maintaining and improving the platform.

The licence does not involve a general transfer of ownership and does not give iCasting the right to commercially exploit user content outside the services, unless the user has given separate consent for this or this has otherwise been agreed in writing.

For promotional communications specifically about the iCasting platform, iCasting may display user content where this falls within the purpose of the licence granted above. For separate commercial campaigns or other use outside the normal operation of the platform, additional consent is required where this is required by law or the circumstances.

4. User warranty

The user declares and, insofar as they can reasonably assess, warrants that they:

• are authorised to post the user content;
• have all necessary copyrights, licences and other permissions;
• do not infringe third-party rights;
• have the necessary consent or other legal basis for identifiable persons in photos, videos and other content;
• do not post content that violates laws and regulations, the Terms of Use or the Terms of Delivery.

The user indemnifies iCasting against third-party claims arising from the absence of required rights, licences, permissions or other legal grounds or from an infringement by the user content, insofar as the cause thereof can be attributed to the user.

5. Use of talent photos and profiles

Talent remains the rights holder of their own photos, videos, profile texts and other self-supplied content. By posting this content, talent grants iCasting a non-exclusive licence to display the content within the platform for profile management, search, matching, evaluation of casting calls and communication with clients.

Clients may use talent's profile photos, profile data and other information solely for evaluating, discussing and entering into or performing a specific casting call.

Clients are not permitted, without permission, to:

• download or systematically copy talent's user content;
• distribute or publicly disclose it;
• store it in their own candidate or marketing database;
• pass it on to clients, casting partners or other third parties, except insofar as this is necessary for the specific casting call and permitted by law;
• use it for advertising, commercial acquisition or unsolicited communications;
• use it for a casting other than the one for which contact was established.

The use of personal data and contact details of talent is also subject to the rules in the Terms of Use, the Terms of Delivery and the Privacy Policy.

6. Removal of content and account

A user may delete their own content or set a profile to inactive via the account settings, insofar as the relevant function is available.

After deletion, content will be removed from active search results and public or user-accessible parts of the platform within a reasonable period, unless further availability is necessary for an ongoing casting call, a payment, a dispute, security, backups or a legal obligation.

Removal from the platform does not automatically mean that copies lawfully stored by other users, already used or retained by backup and archive systems disappear immediately.

iCasting may remove, restrict, make inaccessible or modify content in whole or in part where there is a possible infringement, violation of laws and regulations, breach of the terms, a security risk or a reasonable suspicion of misuse.

7. Infringement notices

Do you suspect that content on iCasting infringes your copyright, trademark right, database right, portrait right, privacy right or other right? Please report this as soon as possible via Report misuse or through the contact page.

A notice must be as clear and complete as possible and should preferably include:

• your name and contact details;
• a description of the right on which you rely;
• an explanation of why the relevant content is infringing;
• the exact URL, profile page, casting call or other location of the content;
• information that makes it plausible that you are the rights holder or are acting on behalf of the rights holder;
• a statement that the information in the notice is, to the best of your knowledge, accurate and complete.

Upon receipt, iCasting will confirm the notice insofar as contact details have been provided. iCasting will assess the notice within a reasonable period and may request additional information. If the notice is sufficiently substantiated, iCasting may remove the content, make it inaccessible, restrict it or suspend the relevant account.

iCasting is not obliged to remove content solely on the basis of an unproven or insufficiently specified claim. A notice may be rejected if it contains insufficient information, is manifestly unfounded or relates to a dispute that must be resolved between the parties concerned.

The notifier will, insofar as legally permitted, be informed of the decision and any further options. The user who posted the content may be informed and may object to a moderation decision in accordance with the procedure in the Terms of Use.

8. Misuse of notices

It is not permitted to knowingly submit false, misleading or malicious notices. iCasting may take appropriate measures in the event of repeated misuse of the notice procedure, including restricting access to the notice function or the account.
